Walnut Grovez Inc ("we", "us", "our") operates Sites Builder, a website builder, at https://sites-builder.com. By creating an account or placing an order through this website you agree to these Terms, to our Privacy Policy, our Refund & Cancellation Policy and our Acceptable Use Policy, all of which form part of this agreement. What each package includes, its limits and its price are shown on the pricing page and again at checkout before you pay. We may change prices or packages for future purchases; a change never affects a period you have already paid for.
One-time purchases
A one-time purchase is charged once, at the price shown at checkout, and never renews. There is nothing to cancel. Refunds follow the Refund & Cancellation Policy below. Charges appear on your card statement as sites-builder.com.
Recurring subscriptions
By enrolling in a recurring subscription you authorise us to charge the payment method you provide for your selected package today and automatically every 30 days thereafter, at the price shown at checkout, until you cancel. Before each renewal we email you 5 to 7 days in advance, and after every successful charge we email you a receipt, at the address on your account. Charges appear on your card statement as sites-builder.com.
Cancellation
You can cancel your subscription yourself at any time: log in and open Easy to Cancel at https://sites-builder.com/account/cancel, then confirm. Cancellation takes effect immediately: no further charges are made and you keep access until the end of the period you have paid for. You can also cancel by emailing [email protected] or calling +1 (888) 821-9398; we action emailed requests within one business day. No cancellation fee applies.
Refunds
Every charge — the first charge of a subscription, a renewal, or a one-time purchase such as the Day Pass — can be refunded in full on request within 30 days of the charge. We review requests within 2 business days; an approved refund is sent to the original payment method within 5 business days of approval and typically appears on your statement 5 to 10 business days later, depending on your bank. Definitions
- "Sites Builder", "we", "us" and "our" refer to Walnut Grovez Inc, the owner and operator of this website and the service.
- "Service" means the website builder described on this website and accessible through your account: the editor, starter designs, image hosting, publishing at an address under this site, forms and export. "Site" means a website you publish with it.
- "Client" or "you" means the person or organisation using the website and the service.
Account creation
To use the service you must create an account on this website and pay the fees for the package you choose. You must be at least 18 years old. You agree to provide accurate and complete information when creating your account and to keep it up to date. You are responsible for keeping your login details confidential and for any activity under your account, and you agree to tell us promptly at [email protected] about any unauthorised use of it. We may use a third-party payment processor to take your payment; the processor's own terms apply to the payment itself. We reserve the right to refuse service, or to suspend or end an account, where we reasonably believe these Terms have been broken or that the account is being used fraudulently.
Acceptable use
You agree to use the service only as described on this website and in accordance with our Acceptable Use Policy, which sets out what the service may and may not be used for and what the limits of each package mean, including fair use of anything described as unlimited. We may limit, suspend or end an account that breaches that policy, contacting you first where it is reasonable to do so.
The service, in detail
Sites Builder is a website design tool. After you subscribe you pick a starter design, edit your pages in the browser, upload images, preview the site live at an address under this site's domain (https://sites-builder.com/s/your-name/) while you work, and export the finished site as a folder of files to host anywhere. Visitors to the preview can send you messages through forms on your pages. What each plan allows — how many website projects and pages, which starter designs, whether the "Made with" badge can be removed, how many form messages a month — is listed on the pricing page and at checkout, and is enforced by the service. The deliverable of every plan is the exported site; the preview address is a working convenience while your plan is active, not hosting we sell.
- The preview address. Every project can be previewed at a path under this site's domain, using this site's security certificate, while your plan is active. Connecting your own domain is not offered; a site you want to run under your own name is exported and hosted where you choose. Changing a project's name changes its preview address.
- How limits count. Website projects and pages per project are what you hold; form messages are counted per calendar month across all your projects; exports are limited to 5 a day and each export file is kept for 7 days. Technical limits on image uploads (10 MB per image, and a total per account that the editor shows when reached) exist to keep the service working and are not a storage product. Where a plan says unlimited, it is unlimited for the ordinary use of one customer and the rate limits that protect the service from abuse (60 form messages an hour per project, 5 a minute per sender) still apply.
- Your visitors' messages. Messages sent through your forms are stored in your dashboard and emailed to your account address. You are the party responsible for what you ask visitors for and for how you use their replies; we process them only to deliver them to you (see the Privacy Policy). Do not ask for payment details, passwords, or health or other sensitive data through a form.
- Your content and ours. You keep the rights you have in your text and images, and you must own or hold a licence for everything you upload and publish. We may ask you for permission to adapt the layout of a published site of yours into a starter design for other customers; we never do so without your written consent. Our starter designs, the editor and the hosting remain ours.
- After a plan ends. The editor and publishing close, forms stop receiving messages, and the preview address shows a notice from 7 days after the plan ends. Export your site as files before then; that copy is yours to keep. Your project remains in your account to resume if you subscribe again (how long we keep it is in the Privacy Policy), and you can delete it at any time.
- Taking a site down. We may pause or remove a site that breaches the Acceptable Use Policy or the law, telling you why.
- Availability. The service and the preview are provided as they are, with no uptime guarantee or service-level agreement; pages are cached at the edge, so a change can take a minute to appear. Support is by email at [email protected] and phone on +1 (888) 821-9398 during Mon–Fri, 9am–6pm.
Intellectual property
All intellectual property in the service, including its software, design, text and trademarks, belongs to us or our licensors. You may not copy, modify, distribute, sell or transfer any part of the service without our written consent. Content you put into the service remains yours.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages arising from or in connection with your use of the service, including loss of profits, goodwill, use or data, even if we have been advised of the possibility of such damages. Our total liability to you for all claims arising out of the service, whether in contract, tort (including negligence) or otherwise, is limited to the amount you paid us for the service in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.
No warranty
The service is provided "as is" and "as available". We make no warranty, express or implied, including of merchantability, fitness for a particular purpose or non-infringement, and we do not warrant that the service will be uninterrupted, timely, secure or error-free.
Indemnification
You agree to indemnify and hold harmless Walnut Grovez Inc, its officers, employees, agents and licensors from any claim, liability, damage, loss, cost or expense (including reasonable legal fees) arising from your use of the service or your breach of these Terms.
Changes to these Terms
We may update these Terms. If a change is material we will email the address on your account before it takes effect. Continuing to use the service after a change takes effect means you accept it; if you do not, you can cancel as described above.
Entire agreement
These Terms, together with the Privacy Policy, the Refund & Cancellation Policy and the Acceptable Use Policy, are the entire agreement between you and us regarding the service.
